Disciplinary proceedings by the Supervisory Board of the NVA

The Supervisory Board of the NVA assesses the actions of the acupuncturist against the NVA Professional Profile and the NVA Statutes and Regulations. A colleague, a patient, or another stakeholder can file a complaint about the actions and omissions of the acupuncturist with the Supervisory Board. The Behavior and Well-being Department can request an opinion from the College on behalf of the NVA.

Complaints can relate to one or more of the following behaviors: violation of the code of conduct, unprofessional treatment, offensive behavior, causing harm, failure to comply with the regulations of the NVA.

The Supervisory Board (Disciplinary Board) only handles complaints submitted in writing. Anonymous complaints will not be processed. Filing a complaint on behalf of someone else is only possible under certain conditions.

Sanctions
If the complaint is justified, the College may impose a disciplinary measure that affects professional practice, such as a warning, reprimand, (temporary) suspension, or expulsion. In this way, disciplinary law contributes to the quality of professional practice. 

Appeal procedure
After a ruling by the Supervisory Board, both parties can appeal to the Appeals Board of the NVA within specified time limits. The Appeals Board assesses whether the Supervisory Board has correctly applied the regulations of the NVA and followed the correct procedure. The ruling of the Appeals Board is binding. A ruling by the Supervisory Board or the Appeals Board can potentially be used in a judicial procedure.
